A group of New York City taxi drivers may proceed as a class in a long-running dispute over the constitutionality of a policy under which their licenses are suspended when they are charged with a crime, but they must litigate their damages individually, a federal judge in the state said.
The two consolidated cases have already been through a bench trial and two appeal determinations, which found that the New York Taxi and Limousine Commission’s suspension procedures are inadequate.
